Simpler Recycling for households in England: what changed in 2026

The change is real but narrower than the headlines suggested. The duty sits on your council, not on you, and one part of it can lawfully arrive later than 31 March 2026.
What actually changed, and for whom
Simpler Recycling for households is a duty on waste collection authorities, not on householders. Where a council has a duty to collect household waste under section 45(1)(a) of the Environmental Protection Act 1990, section 45A now applies in England, and from 31 March 2026 it must collect food and garden waste, paper and card, all other dry recyclables, and residual waste separately from all households, including flats (gov.uk). Councils cannot substitute a bring bank for a kerbside collection: gov.uk states that a public container households have to travel to would not fulfil the duty, and should only supplement collections.
The transitional arrangement most articles leave out
gov.uk states that a transitional arrangement means a local authority has a later implementation date for the collection of food waste set out in the commencement regulations, and that those councils must still collect the dry recyclable streams by 31 March 2026. The dates sit in the Environment Act 2021 (Commencement No. 9 and Transitional Provisions) Regulations 2024. If your council has no food caddy yet, ask it for its date rather than assuming it is in breach, and rather than trusting a national article that quotes one date for every address in England.
Free weekly food waste, chargeable garden waste
- Food waste: at least weekly, free of charge, with two containers provided, a kitchen caddy and a larger outside bin.
- Garden waste: only on request, and chargeable. The duty to collect garden waste applies only where the household has requested the service and paid any charge.
- Collected together? Councils may collect food and garden waste in one container without a written assessment, but if they do, the service must be weekly, and only the garden element may be charged for.
- Dry stream frequency is a local choice. Councils pick the frequency and container mix for the dry recyclables to suit local circumstances.
What happens from 2027
gov.uk states that plastic film packaging and plastic bags will need to be collected with plastic recycling from 31 March 2027. Until that date arrives, film is not part of the household plastic stream, and a council that does not take it is not behind on anything. Treat that date as scheduled rather than as current law, and check the position again nearer the time.
Can you be fined? Only on a narrow test. A council can require specified receptacles by notice under section 46 of the Environmental Protection Act 1990, but in England a penalty needs a written warning first and a finding that the failure caused or was likely to cause a nuisance, or was detrimental to local amenity (section 46A). The default amount, where the council specifies none, is £60 (section 46B).
